The Lagos Special Offences Court sitting in Ikeja has admitted documents containing the Asset Management Corporation of Nigeria (AMCON) Board resolutions on the receivership of Arik Air as evidence in the ongoing criminal trial of the corporation’s former Managing Director/Chief Executive Officer, Ahmed Kuru, and others.
Justice Mojisola Dada admitted the documents yesterday after hearing arguments from the prosecution and defence on their relevance and admissibility.
The proceedings resumed with the continued cross-examination of the fourth prosecution witness, Mr Bawa Usman Kaltungo.
During cross-examination, Kaltungo maintained that Kuru, as AMCON’s Managing Director/Chief Executive Officer, had unfettered powers and unilaterally sanctioned the receivership of Arik Air.
To challenge the testimony, defence counsel, Mr Uyi Giwa-Osagie, tendered AMCON’s Board resolutions to establish that the receivership was a corporate decision.
The prosecution objected to the relevance and admissibility of the documents.
However, after listening to arguments from both parties, Justice Dada ruled that the documents were relevant and admissible, noting that they emanated from AMCON’s Board as a corporate body and were duly certified in accordance with Section 104 of the Evidence Act.
The court subsequently admitted the documents in evidence.
Further hearing was adjourned to October 27, 2026.
The Economic and Financial Crimes Commission (EFCC) had instituted the case against Kuru and other defendants following a petition by human rights lawyer, Mr Femi Falana (SAN), on behalf of the promoters and shareholders of Arik Air.
Other defendants are Kamilu Omokide, a former receiver-manager of Arik Air Limited; Captain Roy Ilegbodu, the airline’s chief executive officer; Union Bank Limited; and Super Bravo Limited.
They are facing five counts bordering on alleged theft, abuse of office and dishonest acquisition of property.
Union Bank is also facing an additional count of allegedly making false statements to a public officer.
