Plaintiff seeks to imprison NBA President, 5 others for contempt over NBA-SPIDEL Conference

According a Form 49 court filing obtained by our correspondent and addressed to Yakubu C. Maikyau, SAN, the President of the Nigerian Bar Association (NBA), the plaintiffs informed Maikyau that the court would be moved to commit him to prison for allegedly disobeying a court order issued by the High Court of Justice in Warri, Delta State.

The notice, obtained by our correspondent, was addressed to Yakubu C. Maikyau, SAN, the President of the Nigerian Bar Association (NBA), as well as other key individuals, including:

Yakubu Philemon, SAN
Ben Oji, the 1st defendant in the suit and leader of the purported caretaker committee
Habib Lawal, Esq., the NBA Publicity Secretary
Charles Ajiboye, Esq., the NBA Assistant Publicity Secretary
Sir Steve Adehi, SAN
The notice, which was issued in connection with the ongoing leadership tussle within the NBA Section on Public Interest and Development Law (NBA-SPIDEL), states that Maikyau and other parties, including Ben Oji, the 1st defendant, and other NBA officials, may face imprisonment for failing to comply with the court’s order.

The court had previously granted an interim injunction restraining the defendants from organizing and holding any conference or conducting elections on behalf of NBA-SPIDEL pending the determination of the substantive suit filed by John Aikpokpo-Martins, a member of the association’s executive committee.

According to the Form 49 notice, the plaintiffs will move the court to commit Maikyau to prison for allegedly disobeying the order, which required the postponement of the NBA-SPIDEL conference until further notice.
