The Federal High Court in Abeokuta on Tuesday dismissed an appeal by the governorship candidate of the Peoples Democratic Party in Ogun State, Buruji Kashamu, to stay proceedings on the matter between the factional chairman of the PDP in the state, Sikirulahi Ogundele, and Independent National Electoral Commission.
The presiding judge, Justice Abubakar Shitu, dismissed the appeal on the grounds that Kashamu was not a party to the matter and as such could not exercise the right to file an appeal.
Justice Shitu on January 30, 2019 fixed February 5 for the hearing of the case.
Counsel for Kashamu, R. A Oluyede, had approached the Court of Appeal in Ibadan seeking to stall the hearing of the substantive matter.
But, after a series of arguments, the judge told Oluyede that his client was not a party to the matter he was appealing, adding that it wais not allowed under the law.
The judge however, adjourned the matter till Thursday for proper hearing.
