Senator Magnus Abe faction of the All Progressives Congress (APC)’s hope to participate in Saturday’s election has suffered another setback as the Court of 
Appeal in Port Harcourt has struck out its suit seeking to be recognized as the authentic candidates in Rivers State.

Counsel to Abe and 41 others, who emerged at the parallel direct primaries, Henry Bello, said he would challenge the decision of the Court of Appeal at the Supreme Court.

Delivering ruling on the suit challenging a Federal High Court’s Justice Kolawole Omotosho judgment that Abe and others were not duly nominated, Justice Betrus Sanga said the appeal was a mere academic exercise.

He (Sanga) explained that in view of recent Supreme Court judgment that upheld the Rivers State High Court nullification of APC’s congresses and primaries in Rivers State, attempting to resurrect a matter that had been laid to rest, the appeal lacks merit.

But Bello and others said his clients have directed him to approach the apex court to hear the matter finally.
