Sanusi risks court contempt charges for parading self as Kano emir – DanAgundi

The Sarkin Dawakin Babba of Kano, Alh. Aminu Babban DanAgundi, has threatened to charge Muhammadu Sanusi II, emir of Kano, for contempt of court failure to obey the Friday ruling of the Court of Appeal.

DanAgundi, a senior traditional title holder and Kano kingmaker loyal to the 15th emir, Alh. Aminu Ado Bayero insisted that Sanusi must subject himself to the rule of law and stop parading as the 16th emir of Kano forthwith.

Addressing a press briefing on Saturday at Nassarawa mini palace, DanAgundi presenting challenging the reinstatement of Sanusi by the Kano State Government insisted that Bayero remains the legally recognized emir in Kano pending the determination of the Supreme Court on the emirate tussle.

Citing the Friday ruling of the Court of Appeal, Abuja division, DanAgundi who had filed a motion on stay of execution of earlier judgment of the appellant Court reminded the fresh order restraining all parties from enforcing the Judgment of the Court of Appeal in Appeal No. CA/KN/126/2024, Kano State House of Assembly and Anor. vs. Alhaji Aminu Babba Mohammad Mustapha, JCA.

He also referenced the second order granting mandatory injunction for the parties to maintain the status quo ante bellum pending the hearing of an appeal filed by the Supreme Court.

According to him, “We went to the Court of Appeal for a stay of execution of its judgment delivered on January 10th, 2025 pending the appeal filed at the Supreme Court. We appealed the verdict of the Appeal Court because we were not satisfied.

“The Court has granted the order restraining the executive of the verdict. The court has also ruled that all parties maintain the status quo ante bellum. This means the status of the emirship should remain as it was before we challenged the matter meaning Alh. Aminu Ado Bayero is still the emir.

“I have heard so many interpretations of the judgment contrary to the verdict of the court especially the version of the state government. But as far as we are concerned the ruling is here and it is clear. And I challenge any lawyer to proof my position wrongly.

“Let me make it clear, I will not hesitate to take further legal action should Sanusi parading himself as emir. We would take him for contempt of court if he paraded himself anywhere as emir of Kano because the rule of law must be followed,” DanAgundi warned.

The pro-Bayero Kingmaker also urged the security agencies including the police and Department of Security Service DSS to ensure the order of the Court of Appeal is enforced pending the final decision of the Supreme Court.

Meanwhile, Kano State Commissioner for Justice and Attorney General, Haruna Isa Dederi, while reacting, insisted that the ruling of the Court of Appeal, Abuja division, on the lingering emirship tussle has not invalidated the reinstatement of Muhammadu Sanusi II as 16th emir.

Besides, Dederi declared that having passed a landmark verdict on January 10th, 2025 that reaffirmed the power of the Kano state government to reappoint Sanusi, it is impossible for the Court of Appeal to set aside or quash its own decision on the same matter.
