*Enhancing efficiency in document signing and transmission
The Evidence (Amendment) Act 2023 defines a digital signature as an electronically generated mark affixed to an electronically transmitted document, verifying the document’s authenticity, contents, and the sender’s identity.
This eliminates the need for physical signatures, allowing individuals to use electronic signatures for signing and transmitting documents. For instance, lawyers can opt for digital signatures to expedite the process of signing and filing court documents efficiently.
Under the provisions of the Evidence (Amendment) Act 2023, electronic oath taking is now admissible in judicial proceedings. This means that affidavits and other documents requiring oaths can be sworn electronically, leading to time savings and streamlined courtroom proceedings.
Moreover, the Act permits affidavits to be electronically sworn through audio-visual methods, restricted to authorized individuals. Copies of these electronically sworn affidavits must be filed with the court’s registry. This enables witnesses to take oaths via video conferencing, reducing the need for physical presence in court and subsequently conserving time and resources.
The implementation of the Evidence (Amendment) Act 2023 is poised to create a substantial impact on judicial processes within Nigerian courts. The advancements introduced by the Act, including the acknowledgment of electronic records and digital signatures, will simplify and expedite the document filing and evidence presentation processes in court.
This transformation will not only enhance the efficiency and promptness of courtroom procedures but will also eliminate administrative obstacles. Furthermore, the Act’s provisions for electronic oath taking via audio-visual means will save both time and resources for witnesses, who would otherwise be required to attend court physically. Overall, the Act aligns the Nigerian legal system with global technological trends, promising positive outcomes for both individuals and businesses at national and international levels.
