“Kangaroo Judgement” comment: Court grants leave for substituted service on Minister

The suit between the Incorporated Trustees of NBA v. Dame Pauline Tallen, KSG (Hon Minister Women Affairs and Social Development) with Suit No: CV/816/2022 has taken a new twist in its development as the Court has ordered substituted service on the defendant.

The suit which was commenced by means of Originating Summons against the Defendant for calling the judgment of Court a “Kangaroo judgment”, was subsequently assigned to Court No. 4 of the FCT High Court, presided over by Hon. Justice Kekemeke.

On the 12th of January 2023, the NBA attempted personal service on the Defendant and this was not possible.

To this effect, the Nigerian Bar Association filed an ex parte motion seeking the Court’s order for service of the originating processes by substituted means. The FCT High Court Abuja then fixed today, the 19th January 2023 to hear the motion.

Appearing for the NIgerian Bar Association (claimant) were Nwabueze Obasi-Obi, Esq.,T. J. J Danjuma, Esq., O. O Amadi, Esq., P. S Adams, Esq., A. V Opadotun, Esq. and C. G Okeke, Esq.

Obasi-Obi who announced the appearance of the lawyers for the Claimant, thereafter sought the leave of the court for his Co-counsel, T. J. J Danjuma to move the application.

Consequently, the application was moved and the court granted leave to serve Dame Pauline Tallen, KSG (Hon Minister Women Affairs and Social Development) with the originating processes and all accompanying processes by substituted means.

The matter has now been adjourned to the 6th of March, 2023.
