A Lagos High Court, Ikeja, has granted leave to a businessman, Samuel Olayiwola and his company M.O. Mudkas Enterprise Nig. Ltd., to enforce earlier judgment of the court by taking possession of about 15 acres of land in Oko Ile village, near Golf Estate in Ibeju Lekki area of the State.

Lagos Chief Judge, Kazeem Alogba, who sat over the matter, held that since the subsisting judgment of the court was appealed against and the window of appeal has elapsed, the claimants could take over the land.

Justice Alogba’s order was sequel to a judgment delivered on March 6, 2020, where the judge dismissed the claims of Trustbond Mortgage Bank Plc and Mr. Hammed Hassan against the claimants.

The Chief Judge ordered the deputy Sheriff to proceed with the execution of the judgment with all due diligence.

According to the order, Olayiwola is to take possession of 15 plots, while his firm possesses 59 plots.

The claimants had filed the action in a suit marked LD/28/10 against the defendants over illegal encroachment on their lands.

Delivering judgment in 2020, Justice Alogba granted all the prayer sought and ordered the defendant to pay the sum of N500, 000 damages to the claimants.

The prayers sought by the claimants, include, a declaration that the 1st claimant is entitled to the statutory right of occupancy over the 78 plots of land ceded to it under contract by the 2nd defendant as more particularly delineated in Survey Plan Nos IGR/1435/119AE/2007/LA.
