The three convicts were tried on six counts including stealing timber valued at N100,000, conducting themselves in manner capable of causing breach of peace and malicious damage of economic trees belonging to the complainant.

Police Prosecutor, Sgt Olubu Apata, told the court that the convicts committed the offences between February 25 and 27, 2019 at Awuloju Farm in Igede-Ekiti in the Igede Magisterial Division, offences which he said contravened sections 516, 81, 390, 356(2), 249(d) and 451 of the Criminal Code, Laws of Ekiti State, 2012.

Apata told the court that the convicts conspired among themselves to commit felony and as well “did conduct themselves in a manner likely to cause breach of peace and entered farmland, which is actual and peaceable possession of one Oluwadare Olowokere and Adekunke Olowokere”.

He said that the convicts stole timber valued at N100,000 belonging to the complainants, adding that they also obstructed one Inspector Aliyu Umar and four other police officers, from performing their lawful duties on their arrest.

He said that the convicts also marked 28 planks of timber with cutlass on the farmland of the complainants and as well “did unlawfully damage economic trees such as cocoa trees, kolanut trees, banana trees and cocoa yam trees belonging to the complainants”.

The convicts pleaded not guilty to all the charge.

The Magistrate, Mrs Adesola Omotosho, found them guilty on three of the counts and consequently sentenced each convict on count one, two and three to six-month imprisonment without an option of fine and discharged them on count four, five and six.

Omotosho said the jail terms were to run concurrently.
