A 59-year-old landlord, Barth Eze, on Friday, appeared before a Yaba Chief Magistrates’ Court in Lagos for allegedly locking his tenant out of his shop and assaulting him with a stick.
Eze, a resident of Surulere area of Lagos, is facing three counts of assault occasioning harm, breach of peace and forcible entry.
The Prosecution, Sgt. Godwin Oriabure, told the court that the defendant committed the offence on Dec. 31, 2018, at Ishaga Road, Mushin, Lagos.
He said Mr Stanley Nwanni rented a shop from the defendant for one year but the landlord began asking him to vacate the shop before the expiration of the rent.
Oriabure further told the court that when Nwanni travelled, the defendant broke the padlock and locked up the shop with another one.
“My lord, when Nwanni went to confront the defendant about locking up his shop, he hit him in the head with a stick,” Oriabure said.
The offence, he added, contravened the provisions of Sections 52, 168 and 173 of the Criminal Laws of Lagos State, 2015 (Revised).
The News Agency of Nigeria reports that the offence of assault occasioning harm stipulates three years imprisonment.
The defendant, however, pleaded not guilty to the offence.
The Chief Magistrate, Mrs Oluwatoyin Ojuromi, admitted the defendant to bail in the sum of N50,000 with two sureties in like sum.
Ojuromi ordered that the sureties must be gainfully employed and show evidence of three years tax payment to the Lagos State Government.
The case was adjourned until June 14 for mention.
