The Ijede Magistrates’ Court 5 sitting in the Ikorodu Magisterial District of Lagos State has cautioned and discharged 19-year-old Timothy Bernard, who was arrested for wearing an army camouflage cap and badge, and had in his possession three live cartridges and one empty shell.
The Investigation Police Officer, Inspector Aminu Isaac, had said Bernard was arrested in Ijede on December 9, 2018, after allegedly stealing a pair of slippers.
According to him, Bernard posed as a soldier until the moment he was caught stealing the slippers.
Bernard, who pleaded guilty to three counts of conduct likely to cause the breach of public peace, use of army camouflage cap and badge, and possession of three live cartridges, told the court on Thursday that he wore the materials because he had no clothes to put on.
He added that he picked the camouflage and the other military items in Yaba where they were abandoned.
The presiding magistrate, Mrs Oshodi Makanju, while delivering her judgement, said despite the fact that the accused was found in the army accessories, he was not capable of using the items for criminal purposes.
She, however, cautioned and discharged the accused on the ground of being a first time offender.
