The Nigeria Employers’ Consultative Association (NECA) has dragged the National Lottery Regulatory Commission (NLRC) before a Federal High Court (FHC) in Abuja for allegedly shutting down its operations.
NECA, on behalf of its member companies including Nigerian Breweries Plc, instituted the suit delineated FHC/ABJ/CS/306/12 following NLRC’s temporary shutdown of its head office in Lagos demanding certain disputed fees.
The plaintiff is, however, challenging the powers of the NLRC to regulate consumer sales promotions in the country, more so as they form part of the marketing and sales activities of the concerned companies.
NECA also alleged that the commission did not obtain any court order for such operation, noting that the subsisting matter was pending at the Court of Appeal in suit no: CA/A/267/2016.
It added that the appeal was filed at the instance of the commission and a cross-appeal was subsequently instituted by NECA against the decision of the FHC.
The association, however, noted that Nigerian Breweries had always ensured that all its consumer sales promotions were vetted and approved by the Advertising Practitioners Council of Nigeria (APCON) and the National Agency for Food and Drug Administration and Control (NAFDAC).
