Judge dismisses Ricky Tarfa’s ‘no case submission’

The Honourable Justice Aishat Opesanwo of a Lagos High Court in Ikeja, has dismissed the no-case application filed by Ricky Tarfa (SAN).The Economic and Financial Crimes Commission (EFCC) had arraigned Tarfa on a three-count charge of obstruction of justice and perverting the course of justice, to which he pleaded not guilty.

The anti-graft commission alleged that the defendant willfully obstructed two of its officers, Moses Awolusi and Sanusi Mohammed from arresting defendant (Tarfa’s) clients, Gnanhoue Sourou and Nazaire Odest, within the premises of a Lagos High Court in Igbosere.

Tarfa through his counsel, Abiodun Owonikoko (SAN), told the court that his client had no case to answer, when he was to open his defence.

The trial judge in her ruling dismissed the application.

Justice Opesanwo said she was satisfied that the EFCC was able to establish a prima-facie case against Tarfa, and asked that he should proceed with his defence.

The proceedings on the matter commenced at 11.30a.m till 5.25p.m.

The judge also declined to award N150 million exemplary damages for ‘malicious prosecution’, which the defendant had demanded from the EFCC.

“I have taken consideration of Section 38(2) of the EFCC Act, Section 97(3) of the Criminal Law of Lagos 2011, and the oral and documentary evidence given by the prosecution.
